The detention and legal process of Fofo Márquez generated controversy on social media, leading his brother, Rodrigo, to express his disappointment towards justice in Mexico. In April 2024, videos went viral showing Fofo Márquez assaulting a woman after a traffic accident in the parking lot of San Mateo, Naucalpan, State of Mexico. The Prosecutor's Office arrested him that same month.
After a legal process that initially considered his release due to the absence of a feminicide profile, he was ultimately sentenced. Rodrigo Márquez, with over 124,000 followers on Instagram, shared his discontent with Mexican justice on the same social network, lamenting what happened. "From the pain of my heart, I express... we are in a country where something media-related is more important than a fair case," he stated.
Although Fofo Márquez admitted his reaction and wished to avoid prison, the sentence found him guilty of attempted feminicide. On Friday, January 24, he was sentenced to 22 years in prison. After the ruling, Rodrigo decided not to address the topic on social media again, asking for respect for his decision.
